1. Agreement to Terms
These Terms of Service (the “Terms”) form a binding agreement between you (“Customer”, “you”) and leatmap, a service operated by SYNTARIE TECH, a sole proprietorship registered in the Netherlands under KvK number 90708830, with registered office at van Randwijcklaan 47 C, 3814 AC Amersfoort, the Netherlands, and VAT number NL004834843B07 (“leatmap”, “we”, “us”). By creating an account, accessing the dashboard at app.leatmap.com, installing the leatmap SDK, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
Merchant of Record. All paid subscriptions to leatmap are sold and invoiced by Paddle.com Market Limited (opens in new tab) (“Paddle”) acting as our reseller and Merchant of Record. Your paymentcontract for any subscription fee is governed by Paddle’s Buyer Terms & Conditions, which apply to billing, taxes, refunds processed through Paddle, and chargebacks. Your servicecontract — the rights to access and use the leatmap Service itself — is governed by these Terms. In the event of a conflict between Paddle’s Buyer Terms and these Terms, Paddle’s Buyer Terms control for payment matters and these Terms control for service matters.
If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and references to “you” mean both you individually and the organisation.
2. Definitions
- Service
- The leatmap product, comprising the JavaScript SDK and any platform SDKs, the ingest collector, the analytics dashboard at app.leatmap.com, the public marketing site at leatmap.com, the documentation at docs.leatmap.com, and any APIs or related software made available by us.
- Customer
- The natural or legal person who registers an Account, accepts these Terms, and is responsible for the Workspace(s) under it.
- Account
- The credentials and login record that authenticates you into the Service.
- Workspace
- A logical container for one or more tracked properties, members, and billing settings under a single Account.
- Events
- Discrete data points sent by the leatmap SDK or any compatible client to the leatmap collector for ingestion and analysis, including page views, custom events, and identify calls.
- Paid Plan
- A subscription plan that requires payment, currently Pro and Business as set out on leatmap.com/pricing.
- Free Plan
- The Hobby tier, made available without monetary charge subject to the volume cap published on the pricing page.
3. Account & Eligibility
You must be at least 16 years old to create an Account. If you are a minor in your jurisdiction (where the relevant age of consent for data processing is higher than 16), you must obtain consent from a parent or legal guardian before creating an Account.
You agree to provide accurate and current information when registering, and to keep that information up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your Account. Notify us immediately at security@leatmap.com if you suspect unauthorised use of your Account or any other breach of security.
We may refuse to open or close any Account at our discretion where doing so is required by law or where, after reasonable investigation, we believe the Account is being used in breach of these Terms.
4. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation, including data protection, export control, or anti-spam laws;
- collect personal data from end users of your tracked properties without a valid lawful basis under the GDPR (or equivalent regime), including obtaining consent where consent is required;
- send Events containing special-category personal data (as defined in GDPR Art. 9), payment card numbers, government identification numbers, or other sensitive identifiers;
- send Events at a volume materially exceeding the cap of your plan with the intent to circumvent fair-use limits, denial-of-service our infrastructure, or otherwise degrade the Service for other customers;
- reverse engineer, decompile, or disassemble the Service, except to the extent that applicable law expressly permits such activity notwithstanding this restriction;
- resell, sublicense, white-label, or otherwise commercially redistribute the leatmap SDK or Service without a separate written agreement with us;
- use the Service to track end users in jurisdictions where you do not have a legal basis to do so, including children under the minimum age in those jurisdictions; or
- probe, scan, or test the vulnerability of the Service or any related system or network, except under a separate, signed security-research agreement.
We reserve the right to investigate and take appropriate action against any suspected breach of this section, including suspending or terminating offending Workspaces.
5. Subscription Plans, Billing & Renewal
The Service is offered under the plans listed on leatmap.com/pricing. Each plan specifies a monthly Event volume cap, included features, and pricing in US dollars.
Recurring billing. Paid Plans are billed in advance on a monthly or annual cycle, depending on the cadence you select at checkout, and renew automatically at the end of each billing period until cancelled. By subscribing, you authorise Paddle to charge your chosen payment method on each renewal date for the same plan and billing cadence, plus any applicable taxes, until you cancel.
Currency and taxes. Prices on the pricing page exclude taxes (VAT, sales tax, GST, or equivalents) unless explicitly stated. Paddle, as Merchant of Record, calculates and collects the correct indirect taxes for your billing address and remits them to the appropriate tax authority. Your invoice from Paddle will reflect the gross amount charged.
Plan changes. You may upgrade your Paid Plan at any time from within the dashboard; the upgrade takes effect immediately and Paddle will issue a prorated charge for the remainder of the current billing cycle. Downgrades take effect at the end of the current billing cycle.
Volume overages. If your monthly Event volume exceeds the cap of your plan, we will not silently throttle ingestion or drop data. We will notify you and offer the choice to upgrade, accept an overage charge at the published rate, or remain in the same plan with a one-time grace period.
Failed payment. If a renewal payment fails, Paddle will retry per its standard schedule and notify you. If payment remains outstanding after a 7-day grace period, your Workspace will be moved to read-only mode (existing data remains queryable, but ingestion of new Events is paused) until payment is resolved. Continued non-payment may result in Account suspension or termination per Section 14.
6. Cancellation
You may cancel your Paid Plan at any time, either from the billing page in the leatmap dashboard or via Paddle’s buyer portal linked from your invoice email. Cancellation takes effect at the end of the current billing period; you retain access to the paid features until that date.
Refund eligibility on cancellation is governed by our Refund Policy.
After cancellation takes effect, your Workspace is automatically downgraded to the Hobby (Free) plan. If your monthly Event volume on the Hobby plan exceeds the free cap, the Workspace enters read-only mode (no new Event ingestion) until either the volume drops below the cap or you re-subscribe.
7. Service Availability
We work to keep the Service available on a best-effort basis and publish operational status at status.leatmap.com (opens in new tab). The Service is provided without a contractual uptime guarantee unless a separate written Service Level Agreement is in place (typically as part of an enterprise engagement on the Business plan).
Planned maintenance is announced in advance through the status page and, where it materially affects ingestion or query availability, by email to billing contacts. Emergency maintenance for security or stability reasons may occur without prior notice.
8. Customer Data & Ownership
You retain all right, title, and interest in and to the Events and derived analytics belonging to your Workspace (“Customer Data”). We do not sell Customer Data. We process Customer Data on your behalf, as a data processor under GDPR Art. 28, in accordance with our Data Processing Addendum, which is available on request and forms part of these Terms when executed.
You grant us the limited, non-exclusive licence to host, process, store, and transmit Customer Data solely as necessary to provide and improve the Service, prevent fraud or abuse, and comply with applicable law.
You may export your Customer Data at any time through the dashboard or the Stats API on plans that include export. On termination, you have 30 days to export Customer Data; after that, we may delete it per our retention schedule (see Privacy Policy, § 7).
9. Intellectual Property
The Service, including the leatmap SDK, the collector, the dashboard UI, the leatmap brand, and all related documentation, is owned by leatmap and protected by copyright, trademark, and other intellectual-property laws. Subject to your compliance with these Terms and timely payment of fees, we grant you a non-exclusive, non-transferable, non-sublicensable, worldwide right to access and use the Service for the duration of your subscription.
We welcome feedback. If you provide suggestions or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback without obligation to you.
10. Confidentiality
Each party may receive non-public information from the other in connection with the Service (“Confidential Information”), which includes Customer Data, our pricing where it is not public, product roadmap details shared in private channels, and any information that a reasonable person would understand to be confidential. The receiving party will (a) use Confidential Information only to perform under these Terms, (b) protect it with the same degree of care it uses for its own confidential information and no less than a reasonable degree of care, and (c) not disclose it to third parties except to its employees, contractors, and sub-processors bound by similar obligations of confidentiality.
Confidential Information does not include information that is or becomes generally known to the public through no breach of these Terms, was lawfully known to the receiving party prior to disclosure, or is independently developed without use of Confidential Information.
11. Disclaimer of Warranties
To the maximum extent permitted under Dutch law, the Service is provided “as is” and “as available”, without any warranty of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. Mandatory consumer-protection rights under Dutch law (Boek 7 Burgerlijk Wetboek) and EU consumer law that cannot be excluded by contract are unaffected by this section.
12. Limitation of Liability
To the maximum extent permitted by Dutch law, the aggregate liability of leatmap to you for any and all claims arising out of or relating to these Terms or the Service, regardless of the form of action, will not exceed the total fees you paid to Paddle for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. For Free Plan users, our aggregate liability is capped at one hundred euros (€100).
In no event will we be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, including loss of profits, loss of goodwill, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) wilful misconduct or gross negligence (opzet of grove schuld); (c) fraud or fraudulent misrepresentation; or (d) any other liability that cannot be limited or excluded under Dutch law.
13. Indemnification
You agree to defend, indemnify, and hold harmless leatmap, its affiliates, and their respective directors, officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service in breach of these Terms; (b) Customer Data, including any allegation that it infringes a third party’s rights or violates applicable law; or (c) your failure to obtain valid consent or another lawful basis for processing personal data of end users through the Service.
14. Suspension & Termination
We may suspend or terminate your access to the Service, in whole or in part, with reasonable advance notice where practicable, if (a) you materially breach these Terms and fail to cure the breach within 14 days of written notice (where the breach is curable); (b) you fail to pay fees due after the 7-day grace period under Section 5; (c) we are required to do so by law, court order, or instruction from a competent authority; or (d) we have a reasonable, good-faith belief that your continued use of the Service poses a security, legal, or operational risk to us, our infrastructure, or other customers.
On termination, your licence to use the Service ends immediately, and you remain liable for all fees accrued before termination. We will provide a 30-day window to export Customer Data, after which we may delete it per our retention schedule. The provisions of Sections 8 (last paragraph), 9, 10, 11, 12, 13, 16, and any other provision that by its nature should survive, will survive termination.
15. Modifications to the Service & Terms
We may evolve the Service over time, including adding, changing, or removing features. Where a change materially reduces the functionality you are entitled to under your current plan, we will provide at least 30 days’ advance notice by email and on the dashboard, and you may cancel for a prorated refund of unused fees.
We may update these Terms from time to time. For material changes (changes that materially affect your rights or obligations), we will provide at least 30 days’ advance notice by email to the billing contact and via an in-product banner. Continued use of the Service after the effective date constitutes acceptance of the updated Terms; if you do not accept, you may cancel before the effective date and request a prorated refund per the Refund Policy.
16. Governing Law & Dispute Resolution
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Netherlands, excluding its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods.
Any dispute, controversy, or claim arising out of or relating to these Terms — including their existence, validity, interpretation, performance, breach, or termination — that is not resolved through good-faith negotiation within 60 days will be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.
If you are a consumer resident in the European Union, the mandatory consumer-protection rights of your country of residence are preserved, and you may also have the right to bring proceedings in the courts of that country. The European Commission also operates an Online Dispute Resolution platform (opens in new tab) at ec.europa.eu/consumers/odr.
